We will collect your name, email address, mailing address, and mobile phone number when you sign up for emails and SMS updates. The information will be collected via the website contact form, email, rental agreement, or third-party reservation systems.

    Data Usage: We use your data solely for sending updates, and reminders related to our products or services. The types of messages a customer can expect to receive are appointment reminders, service or order information, and customer support messages.

    Data Retention

    • We retain your information as long as you are subscribed to our SMS and email marketing service. You may request deletion at any time.
    • MESSAGE AND DATA RATES MAY APPLY. Your mobile carrier may charge fees for sending or receiving text messages, especially if you do not have an unlimited texting or data plan. Messages are recurring, and message frequency varies

    • Opt-Out: You can opt out of the SMS list at anytime by texting, emailing, or replying STOP or UNSUBSCRIBE to hello@dig-digital.com or 587 789 1349. You can send HELP for additional assitance, and you will receive a text including our Phone number, email and website. We are here to help you.

Use of the Service

The Service is intended for users who are 13 years of age or older. By using the Service, you represent and warrant that you are at least 13 years old and of legal capacity to enter into this Agreement.

You agree to not use the Service for any unlawful or unauthorized purpose. You are also prohibited from using the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other user’s enjoyment of the Service.

Intellectual Property

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Limitation of Liability

In no event shall 1527244 Alberta Ltd. (Dig Digital), nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses), arising out of (i) your use or inability to use the Service; (ii) any unauthorized access to or alteration of your transmissions or data; (iii) any statements or conduct of any third party on the Service; (iv) or any other matter related to the Service, whether based on contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damage.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising out of or relating to these Terms will be settled by binding arbitration in accordance with the Arbitration Rules of the Canadian Arbitration Association (“CAA”) or the American Arbitration Association (“AAA”), at your election. The arbitration shall be conducted in Edmonton, Alberta Canada.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding our Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
